In the latest issue of GRUR-Prax, our colleague Theresa Deubler takes a closer look at the BGH’s “14 g Protein” referral to the CJEU and explores why a front-of-pack gram statement, which seems straightforward at first glance, can raise surprisingly complex regulatory issues.
The commentary explores how the LMIV’s repetition ban interacts with the Health Claims Regulation, when a gram figure might count as a legitimate clarification of a nutrient claim, and how absolute quantities can shift the meaning of authorised claims in ways the legislation does not necessarily intend.
With quantitative front-of-pack claims now so common across the food sector, the CJEU’s forthcoming guidance will matter far beyond this individual case.
